REP. NANCY MACE PROPOSES LEGISLATION TO STOP TAXING OVER-THE-COUNTER MEDICINE
Proposal Would Eliminate Sales Tax on Over-The-Counter Medicine
Representative Nancy Mace today proposed “Medicine Tax Relief” legislation that would eliminate South Carolina’s sales tax on over-the-counter (OTC) medicine. South Carolina is one of 35 states that still taxes OTC medicine, adding 6-9% to the cost of everything from cold medicine to pain relievers to allergy medication.
“We don’t tax prescription medicine,” said Rep. Mace. “When you’re sick, you shouldn’t have to pay a tax on the medicine that makes you healthier.”
The legislation uses the federal Food and Drug Administration’s “Drug Facts” panel requirement as the standard, any medicine that carries a Drug Facts label would be tax-exempt. This is the same standard used by Texas, which exempted OTC medicine in 2015.

• The average American household spends approximately $450 per year on OTC medicines
• States that already exempt OTC medicine include Texas, New York, Pennsylvania, Virginia, Minnesota, New Jersey, Maryland, Vermont, Connecticut, Florida (partial), and D.C.
• Exempted items include pain relievers, cold and flu medicine, allergy medication, antacids, first aid supplies, and other FDA-labeled drugs
“This is a common-sense bill,” Mace said. “Families are struggling with the cost of living. The least we can do is stop taxing their medicine.”
